§
32.01 Residence or Tax Paying Status Requirements
for Membership.
(A)
All members of boards, councils, commissions and committees created
pursuant to provisions of the charter and ordinances and resolutions
of the city shall be residents of the city or nonresident tax-paying
property owners of the city but residing within the extraterritorial
jurisdiction of the city.
(B) Any member of a board, council, commission or committee who,
after such member's appointment, shall change such member's residence
of property status so that such member does not comply with either
of the qualifications set out above shall be deemed to have resigned
from such board, commission or committee. (`82

32.02 Appointment of Members; Filling Vacancy.
(A)
Except as otherwise provided by federal law, state constitution,
state statute or the city charter, all appointments to boards,
councils, commissions and committees of the city shall be made
by the City Council.
(B) Any vacancy, for whatever reason, in and during the unexpired
term of an appointed member of any board, council, commission,
or committee of the city shall be filled by the City Council in
the same manner as the original appointment. (`82

32.03 Selection of Chairperson.
All
chairpersons of the boards, councils, commissions and committees
created pursuant to charter, ordinance or resolution of the city
shall be selected by the membership of such board, council, commission
or committee, and shall serve in accordance with the rules and
bylaws of the respective board, council, commission or committee,
and for a term prescribed by such organization. (`82

32.04 Creation of Vacancies.
(A)
If any member of a board, council, commission or committee of
the city dies, becomes disabled or resigns, such office or position
becomes immediately vacant.
(B) Any member of a board, council, commission or committee of
the city who shall absent such member's self from as many as three
consecutive regular meetings of such board, council, commission
or committee on which such member serves shall forfeit such office
as member of such organization, and it shall be the duty of the
remaining members of such board, council, commission or committee
to declare the office vacant and report the same to the City Council;
provided, however, if such absence is found by the majority of
the members of that board, council, commission or committee to
have been occasioned by illness or justified excuse, then such
absence shall not constitute a basis for a declaration of vacancy
of the office of such member.
(C) Any member of a board, council, commission or committee who
shall absent such member's self from more than one-third of the
meetings of a board, council, commission or committee during one
year shall cause such office or position to immediately become
vacant.
(D) If any board, council, commission or committee of the city
shall fail to meet for three consecutive regularly scheduled meetings
because there is not a sufficient number of members to constitute
a quorum, the City Council may, on its own authority, without
a hearing, declare any or all offices or positions of the board,
council, commission or committee vacant. (`82

32.05 Meetings.
All
boards, councils, commissions and committees of the city shall
meet at least one time each two months at designated times and
schedules, and shall report once in writing to City Council promptly
following each meeting by either furnishing a copy of the minutes
of the meeting to the City Manager or by written report of the
activities of the board, council, commission or committee. (`82

§
32.20 Housing Committee.
(A)
Creation. There is hereby created a Housing Committee for the
purpose of advising the City Council on all matters related to
housing conditions and housing needs of the city.
(B) Responsibilities. The specific responsibilities of the Housing
Committee are listed as follows:
(1)
Policy formulation for the administration of the housing assistance
program.
(2) Making all final decisions as to the types of and the conditions
under which housing assistance is to be delivered.
(3) Incorporating into the decision-making process described
above adequate appeals procedures.
(4) Reporting to the City Council and the Community Development
Council as to the progress and status of the housing assistance
program. (`82 Code, § 2-5)
(C)
Membership. The Housing Committee shall consist of five members,
including a chairperson. Each member is to be appointed by the
City Council. The initial terms shall be staggered as follows:
one member to a one year term, two members to two year terms,
and two members to three year terms. Thereafter the terms shall
be for three years. In the event of death, resignation or disqualification
of a member, a successor shall be appointed in the same way as
prescribed for the original appointment of the representative,
and the successor shall serve only for the unexpired term of the
member creating such vacancy. (`82 Code, § 2-6)
(D) Bylaws. The Housing Committee shall have the power to adopt
bylaws for the proper conduct of its business. All such bylaws
adopted by the Housing Committee shall be subject to the approval
or disapproval of the City Council, and shall be promptly submitted
to the City Council for approval or disapproval in whole or in
part, after their passage originally or by amendment and shall
become effective from and at the time of such approval by the
City Council acting at its next regular meeting following the
submittal of such bylaws by the Housing Committee. (Ord.

32.21 Airport Advisory Board.
(A)
Creation and composition. There is hereby created an airport advisory
board to be known as the Edinburg Airport Advisory Board. The
Board shall consist of five members who shall be appointed by
the City Council to serve for a term of three years, and until
their successors have been appointed and have qualified; provided,
however, the terms will be staggered so that two members of the
initial Board shall be appointed for a term of three years each,
two members for a term of two years each, one member for a term
of one year, and all appointments thereafter shall be for terms
of three years each. The members of the Board shall serve without
compensation, except for such reimbursement of expenses as may
be authorized by the City Council. (`82 Code,
§ 3-1)
(B) Organization. At the first meeting of the Board, a majority
of the members present, which shall constitute a quorum, shall
pass rules and regulations to govern the conduct of its meetings
and the transaction of its business; provided, however, that it
shall provide for at least one regular meeting every 60 days.

(C) Powers and duties.
(1)
It shall be the duty of the Board to formulate and submit to
the City Council plans and recommendations for the use, operation
and development of the municipal airport.
(2) The Board shall function in an advisory capacity only and
shall have no power to make personnel appointments or direct
or supervise work operations.
(3) The Board shall not be authorized to incur, on behalf of
the city, any expenses incident to the operation, maintenance,
development or any other expenditure incident to the municipal
airport.
(4) The Board is authorized to accept gifts, donations and contributions
to the airport on behalf of the city.
(5) The City Manager is hereby made an ex officio member of
the Board and shall be entitled to attend all meetings of the
Board, but shall not have the right to vote on any action taken.(`82

32.22 Joint Airport Zoning Board.
(A)
Created. Subject to like provisions being made by the County Commissioners
Court by proper order duly promulgated and entered on its minutes,
and as authorized by the provisions of the Airport Zoning Act,
being Tex. Local Gov't Code §§ 241.001 et seq., there is hereby
created a joint airport zoning board to be known as the Edinburg-Hidalgo
County Joint Airport Zoning Board, which shall have the powers
and exercise the duties set forth in Tex. Local Gov't Code §§
241.011 and 241.012. (`82 Code, § 3-4)
(B) Composition and appointment. The Joint Airport Zoning Board
shall be composed of five members, two to be appointed by the
City Council and two members to be appointed by the County Commissioners
Court. The fifth member shall be elected by a majority of the
members so appointed and the fifth member shall serve as chairperson
of the Joint Airport Zoning Board. (`82 Code,

(C) Terms of office. The initial appointees by the city and the
county shall have terms of three and four years, with the city
designating one appointee to have a term of three years and one
appointee to have a term of four years. Similarly, the county
shall designate one appointee to have a term of three years and
one appointee to have a term of four years. All appointees shall
be eligible for reappointment at the end of their terms, and when
reappointed, shall have terms of five years. (`82

(D) Term of Chairperson. The initial chairperson, elected by the
appointees, shall have a term of five years. The chairperson shall
be eligible for re-election for subsequent five year terms.

32.23 Architectural Design and Site Planning
Board.
(A) Creation and composition. There is hereby created an Architectural
Design and Site Planning Board, to be composed of five members
and two alternates, who shall be appointed by the City Council
in accordance with Chapter 32 of the City Code of Ordinances.
(B) Term of membership. Board members shall be appointed for three-year
staggered terms to provide for continuity. Alternate members shall
be voting members in the absence of regular members. The Director
of Planning and Zoning or his designee shall serve as an ex-officio
member.
(C) Function of Board. All Board members will be required to be
familiar with the architectural design and site planning standards.
The Board, when appealed to and after a hearing, shall have the
authority to vary the application of any provision of the city's
architectural design and site planning standards and when, in
its opinion, the variation meets the intent of the city's standards.
(D) Procedures of the Board. The Board shall establish rules and
procedures for the enforcement of Ord. 1791 and any subsequent
amendments to the ordinance.
(E) Meetings. The Board shall meet on call of the chairman, within
30 days after architectural design and site plans have been submitted
to the city.

§
32.24 Pan American Community Events Authority.
(A)
Subject to the adoption of a concurrent order by the City Council
of the City of Edinburg, the Commissioners Court of Hidalgo County,
Texas, did create on the 5th day of October, 1999, a sports and
community venue district under Chapter 335 of the Act. The district,
entitled the Pan American Community Events Authority. shall be
referred to hereinafter as the "Authority" and shall have all
powers granted to a sports and community venue district authorized
by the Act.
(B) The boundaries of the Authority shall be co-extensive
with the combined boundaries of the City of Edinburg and the County
of Hidalgo.
(C)
(1)
The Authority shall be governed by a Board of Directors
(the "Board"), consisting of six (6) directors (the "Directors"),
including a chairman (the "Chairman") to be appointed from the
Directors in the manner provided herein. Three (3) of such Directors
shall be appointed by the Commissioners Court of Hidalgo County,
and three (3) of such Directors shall be appointed by the City
Council of the City of Edinburg, as follows: Position No. 1
Appointed by the Commissioners Court of Hidalgo County by written
notice to the City Council of the City of Edinburg and the Chairman.
Position No. 2 Appointed by the Commissioners Court of Hidalgo
County by written notice to the City Council of the City of
Edinburg and the Chairman. Position No. 3 Appointed by the Commissioners
Court of Hidalgo County by written notice to the City Council
of the City of Edinburg and the Chairman. Position No. 4 Appointed
by the City Council of the City of Edinburg by written notice
to the Commissioners Court of Hidalgo County and the Chairman.
Position No. 5 Appointed by the City Council of the City of
Edinburg by written notice to the Commissioners Court of Hidalgo
County and the Chairman. Position No. 6 Appointed by the City
Council of the City of Edinburg by written notice to the Commissioners
Court of Hidalgo County and the Chairman.
(2) Successive Directors shall be appointed in the same
manner as the original appointees.
(3) The Chairman shall be appointed from the membership
of the Board, such appointment to be made jointly by the Commissioners
Court of Hidalgo County and the City Council of the City of
Edinburg. The Chairman shall alternate, from term to term, between
a Director from Hidalgo County and a Director from the City
of Edinburg. The Commissioners Court of Hidalgo and the City
Council of the City of Edinburg shall mutually determine the
manner of selection of the City of Edinburg or Hidalgo County
from which the initial Chairman be appointed.
(4) The Chairman shall be the presiding officer of the
Board; and during the absence of the Chairman, or in the event
of a vacancy in such position, the presiding officer of the
Board shall be a Director designated or elected by the Board
as the Vice-Chairman.
(5) A quorum of the Board is a majority of the number
of Directors fixed hereby.
(6) The original appointees shall serve terms as follows:
The original appointees to Positions 2, 4 and 6 shall serve
initial terms expiring on October 1, 2000; and The original
appointees to Positions 1, 3 and 5 shall serve initial terms
expiring on October 1, 2001.
(7) Thereafter subsequent Directors shall be appointed
to serve staggered terms of two (2) years with Directors in
even-numbered positions being appointed to serve terms expiring
on October 1 of even-numbered positions being appointed to serve
terms expiring on October 1 of even-numbered years and Directors
in odd-numbered years being appointed to serve terms expiring
on October 1 of odd-numbered years. Nothing contained herein
shall prohibit a Director from being reappointed to the Board
upon the expiration of such Director's initial or subsequent
term.
(8) A Director (including a Chairman) may be removed
at any time without cause by the Commissioners Court or the
City Council who appointed such Director. In the case of the
removal of the Chairman, written notice of the removal shall
be provided to the Director, the Chairman and the non-appointing
County Commissioners Court or City Council. In the case of the
removal of any Director other than the Chairman, written notice
of the removal shall be provided to the Director, the Chairman
and the non-appointing County Commissioners Court or City Council.
(D)
Bylaws of the Authority (the "Bylaws)" shall be prepared by
the Board and forwarded to the Commissioners Court of Hidalgo
County and the City Council of the City of Edinburg for concurrent
approval. After such concurrent approval by the Commissioners
Court and the City Council, the Bylaws shall govern the organization
and operation of the Authority.
(E) In accordance with Section 335.072 of the Act, the
Authority shall establish by resolution of the Board a fund known
as the venue project fund and use money in such fund for planning,
acquiring, establishing, developing, constructing or renovating
one or more approved sports and community venue projects authorized
by the Act.
(F) The Commissioners Court of Hidalgo and the City Council
of the City of Edinburg expressly reserve the right of prior approval
with respect to (a) any resolution of the Authority calling a
Special Election and (b) the issuance by the Authority of bonds
or other obligations to pay the costs of each approved venue project.
(G) Subject to the provisions of the Act, the Commissioners
Court of Hidalgo and the City Council of the City of Edinburg
shall direct the Board to adopt a resolution calling a Special
Election whereby the voters of the City of Edinburg and Hidalgo
County shall consider the designation of each venue project and
each method of financing approved venue project.
